"The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Nigeria. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. THESE TERMS INCLUDE, AMONG OTHER THINGS, YOUR AUTHORIZATION FOR DEBITS AND CREDITS FROM AND TO YOUR BANK ACCOUNT (AS DEFINED BELOW) VIA THE AUTOMATED CLEARINGHOUSE NETWORK ("ACH") AND A BINDING ARBITRATION PROVISION CONTAINING A CLASS ACTION WAIVER.

You hereby grant FOURTHMAN NOTIONS NETWORK LIMITED a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media. We grant you a non-assignable, non-exclusive and revocable license to use the software provided as part of our services in the manner permitted by these Terms. This license grant includes all updates, upgrades, new versions and replacement software for you to use in connection with our services. Any feedback, comments, or suggestions you may provide to us and our services is entirely voluntary and we will be free to use such feedback, comments or suggestion as we see fit without any obligation to you.

How do I use the Services?

The purpose of the Services is to try to help you save money on our SAVERS scheme from as little as N100.Money can be paid into your wallet via debit card(charges may apply),bank transfers or from any of our agent banking centres spread across the country. You can request for your savings at anytime or at the end of your saving validity as set by you. The funds in your KPOLOM Account are held at a bank for your benefit. Your funds will remain in your KPOLOM Account until you instruct us to transfer any or all of your funds from your KPOLOM Account to your Bank Account by requesting for a cashout. We will generally transfer the requested funds from your KPOLOM Account to your Bank Account within two Business Days of when we receive your request. It is important to know the amount of available funds in your KPOLOM Account before instructing us to transfer funds from your KPOLOM Account to your Bank Account. If you do not have sufficient available funds in your KPOLOM Account to cover the amount of the requested transfer, your request for the transfer will be declined. We may also transfer funds from your KPOLOM Account to your Bank Account without notice to you upon the closure of your KPOLOM Account as described below and at any time if required by applicable law or if we, in our sole discretion, suspect the Services are being used for illicit purposes or otherwise in violation of these Terms. You may not use the funds in your KPOLOM Account to make purchases, withdraw cash, transfer funds to third parties, or for any other purpose. You are solely responsible for determining whether the funds debited from your debit card and the funds maintained in your KPOLOM Account are acceptable to you. We are not responsible for any third-party fees that may be incurred as a result of using the Services, including, but not limited to, third-party fees incurred as a result of maintaining insufficient funds in your Bank Account. You can only cashout from a CONTRIBUTION you joined when it is your month of collection.KPOLOM will not alter the collection formular as agreed by willing participants in that collection round.KPOLOM does not recommend participants to join a specific contribution round. Participants are advised to join/create contribution round with people they know or trust as we will not be held liable if a participant refuses to make his contribution after he/she must have collected from a previous collection round. KPOLOM at no time will ever create a CONTRIBUTION round.All CONTRIBUTION rounds are created by customers. KPOLOM is not a financial adviser, and the Services are not intended to provide financial advice. Your financial situation is unique. We are not responsible for ensuring your debit card has sufficient funds for your needs, purposes, or transactions. We do not make any representations, warranties, or guarantees of any kind that the Services are appropriate for you. Before using the Services, you should consider obtaining additional information and advice from a financial adviser.

Actions by KPOLOM

If, in our sole discretion, we believe that you may have engaged in any violation of this Acceptable Use Policy, we may (with or without notice to you) take such actions as we deem appropriate to mitigate risk to KPOLOM and any impacted third parties and to ensure compliance with our Acceptable Use Policy. Such actions may include, without limitation:

Blocking the settlement or completion of one or more payments;
Suspending, restricting or terminating your access to and use of the KPOLOM’s Services;
Terminating our business relationship with you, including termination without liability to KPOLOM of any payment service agreement between you and KPOLOM;
Taking legal action against you;
Contacting and disclosing information related to such violations to (i) any banks or Card Networks involved with your business or transactions, (ii) law enforcement or regulatory agencies, and (iii) other third parties that may have been impacted by such violations; or
Assessing against you any fees, penalties, assessments or expenses (including reasonable attorneys’ fees) that we may incur as a result of such violations, which you agree to pay promptly upon notice.

Updates, Modifications & Amendments

We may need to update, modify or amend our Acceptable Use Policy at any time. We reserve the right to make changes to this Acceptable Use Policy. We advise that you check this page often, referring to the date of the last modification on the page.

Disputes & Reversal

If you believe that an unauthorized or otherwise problematic transaction has taken place, you agree to notify us immediately, to enable us take action to help prevent financial loss. All claims against us related to payments should be made within 15 (fifteen) days after the date of such payment. It will be taken that you waive all claims against us, to the fullest extent of the law after the said period of time. If you enter into a CONTRIBUTION with other users and have a dispute over payments, we have no liability for such. We may intervene in disputes between users in a CONTRIBUTION concerning payments but have no obligation to do so. Your transaction ID and/or transaction details will be required to resolve all disputes

Applicable Law

These Terms of Use shall be interpreted and governed by the laws currently in force in the Federal Republic of Nigeria.

Legal Disputes

We shall make an effort to settle all disputes amicably. Any dispute arising out of this Terms of Use, which cannot be settled, by mutual agreement/negotiation within 1 (one) month shall be referred to arbitration by a single arbitrator at the Lagos Multi-Door Courthouse (“LMDC”) and governed by the Arbitration and Conciliation Act, Cap A10, Laws of the Federal Republic of Nigeria. The arbitrator shall be appointed by both of us (we and you), where both of us are unable to agree on the choice of an arbitrator, the choice of arbitration shall be referred to the LMDC. The findings of the arbitrator and subsequent award shall be binding on both of us. Each of us shall bear our respective costs in connection with the Arbitration. Venue for the arbitration shall be Lagos, Nigeria.

Fees for using this Services?

KPOLOM is set up with “service” as its most important objective, not profit. To help cover cost of administration,network infrastructure,insurance,employee salaries and overheads,KPOLOM charges a small fee of 3 percent(3%) of the financial goal set by you for savings for e.g if your savers target is ₦20,000 our charge is ₦600 only.

For a contribution transaction, we charge 2 percent(2%) of the total sum each participant is to receive per round, for e.g if a participant is to receive ₦100,000 at the end of a round,our charge would be ₦2,000 only.
It is important to note that creating a KPOLOM account is completely free of charge.
